VICTORIA The following conditions of sale (‘Conditions of Sale’) will apply to and bind the purchaser of any Jumpz Trampoline Park product described in the Website.

THESE CONDITIONS AFFECT AND RESTRICT YOUR LEGAL RIGHTS!
The Trustee for Bloom Entertainment Group (ABN78 915 839 754) (the "Supplier"), trading as Jumpz Trampoline Park, offers you (the “customer”) use of recreational services and facilities (the "recreational services") at Jumpz Trampoline Park (the "park") on the terms and conditions (the "conditions") set out in this document. The recreational services are all services provided by the supplier associated with the use of the park for recreational activities. The recreational services include, but are not limited to trampolining, trampoline lessons, foam pit, playground, layout, construction, design, maintenance, the condition, the presence of people or objects thereon and all other equipment inside this venue.
PURCHASE OF WRISTBAND

By purchasing a wristband for or by using or making use of any of the recreational services at the park, the customer accepts and agree to be bound by these conditions. Even if you fail to purchase a wristband or pay an applicable fee, if you use any of the facilities at the park or make use of any of the recreational services, by such use you agree to and will be bound by these conditions.
EXCLUSION OF LIABILITY

The supplier, its employees, directors, and agents are not liable to the customer, your dependents, or legal representatives for any personal injury or death suffered by the customer due to the negligence, breach of contract, statute or statutory duty of the supplier, including but not limited to any liability for recreational services not being rendered with due care and skill or were not reasonably fit for their purpose from the use of the recreational services by the supplier.
INHERENT RISKS AND HAZARDS WARNING

The customer acknowledges that the recreational services and associated activities are inherently dangerous with many risks and hazards and as a consequence may cause serious personal injury, permanent disability or death can occur and the customers assume and accept all such risks and hereby waive the right to sue the supplier, its employees, directors and agents, for any personal injury or death suffered by you in any way whatsoever caused by or arising from the customers use of such recreational services or your participation in such activities These risks and hazards include, but are not limited to, the following specific risks:

Falls from trampolines, climbing walls, foam pits, or other equipment, which may result in sprains, strains, broken bones, or head and neck injuries.

Collisions with other participants or objects, which may result in bruising, contusions, sprains, or fractures.

High-impact activities such as flips, jumps, or bag jumps that could lead to serious injuries including concussions, spinal injuries, or broken bones.

Slips on wet or uneven surfaces that could cause ankle, wrist, or knee injuries.
-
Trampoline malfunction or improper use of the equipment, which may result in accidents or injury.

Foam pit risks: While foam pits provide cushioning, the depth of the foam may lead to difficulty in exiting or potential injury due to improper landing.

The customer voluntarily accepts and assume all such risks by participating in the recreational services.

WARNING UNDER AUSTRALIAN CONSUMER LAW: If you participate in these activities, your rights to sue the supplier under the Australian Consumer Law & Fair Trading Act 2012 for any injuries sustained because the activities were not supplied with due care and skill or were not reasonably fit for their purpose are excluded, restricted, or modified as set out in this document. However, this does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law & Fair Trading Regulations 2012andsection 22(3)(b) of the Australian Consumer Law & Fair Trading Act 2012.
AGE AND SUPERVISION REQUIREMENTS

Age Restriction: Children must be at least 18 months of age to use the facilities at the park. Children under 12 years of age must be supervised by a responsible adult at all times. Where you are responsible for such children, you acknowledge that you have explained the inherent risks of the activities to such children and agree to be fully responsible for their actions and welfare during participation.

Parental Acknowledgment: By purchasing a wristband or use of the recreational service for a child, the customer agrees to fully indemnify the Supplier for any loss, injury, or damage that may arise due to the child’s participation in the activities. You will also ensure that your child adheres to all safety rules and guidelines outlined by the Supplier. Where you are responsible for such children you agree to be bound by these conditions on their behalf and you will directly supervise them at all times
HEALTH AND SAFETY REQUIREMENTS

The customer and all participants must be in good health and free from any medical conditions that could adversely affect your ability to safely participate in the activities. For safety reasons, pregnant women, people with pre-existing medical conditions, or those wearing casts are not permitted to participate in the activities. If in doubt, you must seek medical advice before engaging in any activities.

Medical Emergencies: The customer agrees to pay the cost of and authorise the supplier to take all necessary steps to protect your welfare in the event of an injury, including the administration of emergency medical treatment and ambulance transportation, if required.

Compliance with park rules: The customer and all participants must comply with all signs or other directions of the supplier. The supplier reserves the right to suspend or cancel your wristband or access to the recreational services at its discretion for non-compliance with these conditions or for reckless or careless conduct.
MEDIA CONSENT

While in the park, you consent to images and videos being taken of you, your children, or children for whom you are responsible, for security or promotional purposes. If you do not wish to consent to this, please notify the Supplier in writing before participating.
TICKET AND WRISTBAND CONDITIONS

All wristbands, tickets, and passes remain the property of the supplier. They are non-refundable, non-transferable, and void if tampered with. They are valid only for the date shown and are not transferable to other dates or people.
PURCHASE ON BEHALF OF ANOTHER PERSON AND INDEMNITY

If you purchase a wristband for the use of the recreational service or any other equipment or facilities at the park on behalf of another person, you make that purchase as their authorised agent and both you and the person for whom you are purchasing will be bound by these Conditions. By using or making use of the recreational services, that person acknowledges and agrees to the Conditions as if they had read this document and made the purchase themselves. If you are purchasing on behalf of a child, you agree to indemnify the Supplier for any loss or damage caused by or on behalf of that child.
GOVERNING LAW AND JURISDICTION

These conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Australia and, where applicable, the laws of the State in which the activities are provided. The courts of the relevant State or Territory shall have exclusive jurisdiction over any disputes. If any of these conditions should be determined to be void, invalid or otherwise unenforceable, such conditions shall be deemed deleted and the remaining conditions shall remain and continue to be valid, binding and enforceable.
By purchasing a wristband, ticket, or using the recreational services, you acknowledge that you have read, understood, and agree to the above conditions.

CONDITIONS OF SALE
Please read these Conditions of Sale carefully before using the Jumpz Trampoline Park Website. By using the Jumpz Trampoline Park Website, you are agreeing to be bound by these Conditions of Sale.

19. The Jumpz Trampoline Park Website may provide links to third party websites and the products or services of third parties. Jumpz Trampoline Park disclaims all responsibility and liability in any way. You assess or use of the third party sites is at your own risk.
20. The Jumpz Trampoline Park Website may from time to time display third party advertisements. Such advertisements or may not contain hyperlinks to third party websites. Jumpz Trampoline Park does not endorse or recommend the goods or services of such advertisers or their websites.
21. Copyright in the Jumpz Trampoline Park Website is owned by Jumpz Trampoline Park or its licensors.
22. The Jumpz Trampoline Park Website may contain trade marks or logos of Jumpz Trampoline Park, other companies or organisations and these are proprietary to the owner(s) of such marks.
23. Jumpz Trampoline Park may at any time discontinue or limit access to the Jumpz Trampoline Park Website or its content. Jumpz Trampoline Park may terminate or limit your assess to the to the Jumpz Trampoline Park Website if you breach these conditions. All disclaimers and limitations of liability by Jumpz Trampoline Park will survive termination.
ORDERING FROM THE JUMPZ TRAMPOLINE PARK WEBSITE
24. You may offer to purchase any of the Jumpz Trampoline Park products described in the Jumpz Trampoline Park Website for the price specified on the Jumpz Trampoline Park Website.
25. Your order must contain your name, phone number, e-mail address, credit card details and any other ordering information specified on the Jumpz Trampoline Park Website.
26. Payment must be effected by credit card using the payment system on the Jumpz Trampoline Park Website.
27. Confirmation of your purchase will be sent to your nominated email address once your payment for the transaction has been cleared. If you do not receive a confirmation email within two (2) business days please contact the Jumpz Trampoline Park.
28. You may not cancel an order once it has been submitted and paid, even if a confirmation email from Jumpz Trampoline Park is still pending.
29. If you wish to purchase a Jumpz Trampoline Park product by telephone, post or by visiting one of the Jumpz Trampoline Park venues then any such purchase will be governed by these Conditions of Sale (excluding any of the Conditions of Sale that are specific to purchases made using the Website) but including the conditions displayed at the Jumpz Trampoline Park venue. 30. The prices of the Jumpz Trampoline Park products shall be the prices displayed on the Jumpz Trampoline Park Website on the date of your order (inclusive of Goods and Services Tax (“GST”) and any other charges which must be mandatorily disclosed under the Competition and Consumer Act 2010(Cth).
31. All prices displayed on the Jumpz Trampoline Park Website are quoted in Australian dollars and must be paid in full, except where discounts are offered as detailed on the Jumpz Trampoline Park Website.
CANCELLATION DUE TO ERROR OR UNAVAILABILITY
32. You acknowledge that despite Jumpz Trampoline Park’s reasonable precautions, Jumpz Trampoline Park’s products may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error, unavoidable circumstances or other oversight. In these circumstances, Jumpz Trampoline Park reserves the right to cancel the transaction, notwithstanding that your order has been confirmed and your credit card has been charged.
33. If a cancellation occurs in accordance with the clause 32, after your credit card has been charged for the purchase, Jumpz Trampoline Park will immediately issue a credit to your credit card account for the amount in question.
DETAILS OF CONDITIONS APPLICABLE TO PURCHASE OF JUMPZ TRAMPOLINE PARK PRODUCTS
34. Details of the conditions applicable to the purchase of Jumpz Trampoline Park products on the Jumpz Trampoline Park Website may differ from time to time. Jumpz Trampoline Park reserves the right to make any changes to the details and Conditions of Sale if necessary to comply with any applicable legislation and to change the details and conditions published on the Jumpz Trampoline Park Website, without affording notice, provided that this does not materially affect the nature of the Jumpz Trampoline Park products purchased by you. Order submission and your agreement to these Conditions of Sale
35. When you click on the “I Agree” checkbox you agree to these Conditions of Sale and Jumpz Trampoline Park will treat the order as confirmed. You are responsible for ensuring the accuracy of your order. Jumpz Trampoline Park shall supply you, subject to availability, with Jumpz Trampoline Park Products set out in your order. Jumpz Trampoline Park shall confirm each order made online via the Jumpz Trampoline Park Website or by email within two (2) business days.
SECURITY POLICY
36. When purchasing from the Jumpz Trampoline Park Website your financial details are passed through a secure server.
37. No transmission over the Internet can be guaranteed as totally secure. Whilst Jumpz Trampoline Park strives to protect such information, it does not warrant and cannot ensure the security of any information, which you transmit to it. Accordingly, any information which you transmit to Jumpz Trampoline Park, including your credit card details, is transmitted at your own risk and Jumpz Trampoline Park shall have no liability to you for any financial or consequential loss or damage suffered by you in anyway whatsoever arising out of or related to your use of this website whether due to negligence, breach of contract, statute or statutory duty by Jumpz Trampoline Park.
38. Once Jumpz Trampoline Park receives your transmission, it will take reasonable steps to preserve the security of such information.
REFUND POLICY
39. All bookings are non refundable and non transferable.
40. All bookings effected by Government forced lockdowns will be rescheduled to the next availability timeslot upon reopening.
